Welcome to Prestige Flowers Singapore. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

These Terms are governed by the laws of the Republic of Singapore and comply with the Sale of Goods Act (Cap. 393), Consumer Protection (Fair Trading) Act (Cap. 52A), and other applicable Singapore legislation.

1. Definitions

  • "Company," "we," "us," or "our" refers to Prestige Flowers Singapore
  • "Customer," "you," or "your" refers to the person or entity placing an order
  • "Products" refers to floral arrangements, luxury branded items, and related goods
  • "Services" refers to customization, delivery, and other services we provide
  • "Website" refers to our online platform and associated digital properties

2. Acceptance of Terms

By placing an order or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

3. Orders and Contracts

3.1 Order Placement

When you place an order, you are making an offer to purchase our Products under these Terms. We reserve the right to accept or decline your order at our discretion. A binding contract is formed when we send you an order confirmation.

3.2 Order Accuracy

You are responsible for providing accurate delivery information. We are not liable for delays or non-delivery caused by incorrect information provided by you.

3.3 Product Availability

All Products are subject to availability. We reserve the right to substitute flowers or luxury items with comparable alternatives of equal or greater value if the original items are unavailable.

4. Pricing and Payment

4.1 Prices

All prices are displayed in Singapore Dollars (SGD) and are inclusive of Goods and Services Tax (GST) where applicable. Prices are subject to change without notice, but changes will not affect orders already confirmed.

4.2 Payment Methods

We accept various payment methods including credit cards, debit cards, and electronic payments. Payment must be received in full before we process your order. All payments are processed securely through third-party payment processors.

4.3 Payment Authorization

By providing payment information, you represent and warrant that you are authorized to use the payment method and that all information is accurate.

5. Delivery

5.1 Delivery Areas

We deliver within Singapore. Delivery fees may apply based on location and order size.

5.2 Delivery Times

We strive to deliver on the requested date and time. However, delivery times are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to traffic, weather, or recipient unavailability.

5.3 Delivery Procedures

  • If the recipient is unavailable, we will attempt to leave the delivery in a safe location or with a neighbor
  • We may contact the recipient or sender to arrange alternative delivery
  • We are not responsible for Products left in safe locations or with neighbors
  • Perishable items (flowers) cannot be returned once delivered

5.4 Failed Delivery

If delivery fails due to incorrect information or recipient unavailability, additional fees may apply for redelivery.

6. Cancellation and Refunds

6.1 Cancellation Policy

  • Orders may be cancelled up to 24 hours before the scheduled delivery time for a full refund
  • Cancellations made less than 24 hours before delivery may incur a cancellation fee
  • Same-day orders cannot be cancelled once confirmed

6.2 Refund Policy

Refunds will be issued to the original payment method within 7-14 business days. We reserve the right to inspect Products before issuing refunds. Refunds are provided in accordance with Singapore consumer protection laws.

6.3 Non-Refundable Items

Due to the perishable nature of flowers, refunds are only provided if Products are significantly not as described or damaged upon delivery. Photographic evidence may be required.

7. Product Quality and Freshness

We guarantee the freshness and quality of our flowers at the time of delivery. Flowers are living products and will naturally wilt over time. Expected longevity is 5-7 days with proper care. We provide care instructions with each delivery.

If you are dissatisfied with the quality upon delivery, you must notify us within 24 hours with photographic evidence.

8. Luxury Branded Items

All luxury branded items (Dior, Chanel, etc.) sold through our services are authentic. We source our products from authorized distributors and retailers. Branded items come with manufacturer's warranties where applicable. We are not liable for manufacturer defects beyond facilitating warranty claims.

9. Limitation of Liability

To the maximum extent permitted by Singapore law:

  • Our total liability for any claim shall not exceed the amount paid for the specific order
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for emotional distress, disappointment, or similar claims
  • We are not liable for delays or failures due to force majeure events

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and designs, is the property of Prestige Flowers Singapore or our licensors and is protected by Singapore and international copyright laws. You may not reproduce, distribute, or use any content without our express written permission.

11. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which complies with the Personal Data Protection Act 2012 (PDPA) of Singapore. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore.

12.2 Jurisdiction

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Singapore.

12.3 Mediation

Before initiating legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations and, if necessary, mediation.

13. Consumer Protection Rights (Singapore)

Under the Consumer Protection (Fair Trading) Act (Cap. 52A), consumers have statutory rights including protection against unfair practices. Nothing in these Terms affects your statutory rights as a consumer.

If you have concerns about unfair trading practices, you may contact the Consumers Association of Singapore (CASE) or the Competition and Consumer Commission of Singapore (CCCS).

14. Indemnification

You agree to indemnify and hold harmless Prestige Flowers Singapore, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of our services.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prestige Flowers Singapore regarding the use of our services.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitute acceptance of the modified Terms. We encourage you to review these Terms periodically.
